    How does one start a class-action lawsuit, anyway?

    I'm no expert/lawyer, but my understanding and experience is that after filing an initial suit, you can then present evidence to support a class action.

    The only "class action" lawsuits I have been a part of in the past- they promised to get money back, but the only ones to make any money back on them were the lawyers in the case.


    I'm still waiting for my Freddie Mac case to go to trial.

    And before that, I had one that, after about 5 years, said they would give me $5 if I would just call it good and quit.


    ((sigh))

    The only folks making money from class-actions are in fact the lawyers...

    This is an excerpt from my local paper this morning about the Equifax security breach.

    ''Enrolling in the free credit file monitoring and identity theft protection products that we are offering as part of this cybersecurity incident does not prohibit consumers from taking legal action. We have already removed that language from the Terms of Use on the site www.equifaxsecurity2017 .com . . .

    ''Again, to be as clear as possible, we will not apply any arbitration clause or class action waiver against consumers for claims related to the free products offered in response to the cybersecurity incident or for claims related to the cybersecurity incident itself.''

    Well, that's an improvement. And the small claims court bot is novel approach to addressing a problem directly. However, nothing can repay the breach of privacy and security in our lives because of this event. I think there are some very bad players out there and this data will be used to cause a massive financial disruption at some point.

    Is there a time frame or statute of limitation on filing a class action suit? Working for the Government, I'm sure the Chinese and/or Russians already have most of my personal information but don't believe we can sue the Federal Government unless they allow us to.

    Equifax story indicates that drivers license info was included. For 2016, you were required to enter ID number on your tax form which if true could increase the number of tax returns being filed.

    Within the Board Room, and in the Executive Offices, many, many decisions on the IT budget and strategies, for business purposes, were made that led directly to this adverse and potentially devastating impact on people's lives.

    Until people care enough to demand laws that generate perp walks, real perp walks and prison time for executives that really don't want to see prison as a forwarding address, and for certain, those decisions and trade offs will continue.

    The theory that class action lawsuits will create different decisions by punishing the parties who made those decisions only works when public shaming causes the Board to worry about themselves.

    When we let our congresscritter off the hook by having a media circus they use to calm the serfs, we are at fault.
